deHUB Access – Terms of Service
Welcome to deHUB Access. This page (together with thedocuments referred to in it) tells you the terms (“Terms”) which apply when youorder any private catering services or items (the "Items”) from thecatering service provider we partner with, being DeHUB Limited (“CateringPartner”), on our deHUB Access mobile applications (each referred to asan “Application”) and the related services, including the subsequentprovision and your use of any premises arranged by the Catering Partner(“Premises”) and the Items.
Please read these Terms carefully before ordering any Items(including arranging the delivery) from our Application. If you have anyquestions relating to these Terms, pleasecontact Admin@dehub.com.hk before you place a booking and/or anorder. By accessing and using the Application, you agree and confirm that youhave read, understood and accepted these Terms. If you do not agree or fallwithin the Terms, please do not use the any of the Application, the Premisesand/or the Items.
Users below the age of 18 must obtain consent from parent(s)or legal guardian(s), who by accepting these Terms shall agree to takeresponsibility for your actions and any charges associated with your use of theApplication and/or purchase and use of the Items. If you do not have consentfrom your parent(s) or legal guardian(s), you must stop using/accessing theApplications immediately.
These Terms shall be binding on yourself, deHUB Access andthe Catering Partner. deHUB Access reserves the right to change or modify theseTerms (including our policies which are incorporated into these Terms) at anytime. You are strongly recommended to read these Terms regularly. You will bedeemed to have agreed to the amended Terms by your continued use of theApplications and/or the use of the Partner Services (as defined hereinbelow)following the date on which the amended Terms are posted.
Purpose
deHUB Access is operated by PMDC Encode Limited, a companyincorporated and registered in Hong Kong, whose company number is 2402745. Theterms “we” or “us” or “deHUB Access” in these Terms refer to PMDC EncodeLimited.
Our objective is to link you to the catering serviceprovider we partner with, being DeHUB Limited (“Catering Partner”), and allowyou to order Items for delivery (our “Service”) to the Premises or otherlocations you may select. deHUB Access provides the service of assisting andconcluding your order for the Items provided by the Catering Partner from ourApplication and managing your experience throughout the order process. You willenter into a direct contractual relationship with the Catering Partner. Uponconfirmation of your order, your Items will be delivered to you by the CateringPartner to the address you selected at check-out.
Service Availability
The Catering Partner may have a prescribed delivery area(which includes the Premises). This delivery area may change at any time due tofactors such as weather, or demand on our Service. This is to ensure that Itemsreach your designated location at their best. The Catering Partner also decidesits own operating hours. If you try to order a delivery to a location outsidethe delivery area or operating hours of the Catering Partner, or theApplication is otherwise unavailable for any reason, we will notify you thatordering will not be possible.
If you select to deliver the Items to the Premises, pleasenote that we are not an owner or operator of the Premises, and do not sell,resell, furnish, provide, rent, license, manage or control the Premises. TheCatering Partner is solely responsible for arranging and preparing the Premisesfor your perusal. The availability of the Premises is also subject to factorssuch as weather. In case a typhoon warning signal no.3 or above, a blackrainstorm warning signal or other adverse weather conditions occur on the dayof your rental of the Premises, the Catering Partner may rearrange, canceland/or postpone your booking to another date, subject to availability of thePremises.
Orders
When you place an order through our Application, it needs tobe accepted by us and the Catering Partner before it is confirmed. We will sendyou a notification or email if your order has been accepted(the “Confirmation Notice”). The contract for the supply and delivery ofany Item you have ordered comes into existence when we send the ConfirmationNotice. You are responsible for paying for all Items ordered using youraccount, and for related delivery charges and service charges (if any), and forcomplying with these Terms, even if you have ordered the Item for someone else.Any minimum order value will be displayed on our Application. All Items aresubject to availability.
The Catering Partner may use nuts or other allergens in thepreparation of certain Items. Please contact us or the Catering Partner atleast five days prior to ordering if you have an allergy. deHUB Access is notobligated to provide ingredient information or allergen information on theApplication. deHUB Access cannot guarantee that any of the Items sold by theCatering Partner are free of allergens.
